2.3 Exclusions - When Performance Guarantee Does NOT Apply

Bot/Fraudulent Traffic: If majority of traffic is from bots, scrapers, or fraudulent sources
Non-Functional Checkout: If your checkout process is broken, has errors, or extremely high friction
Missing Business Address: If you fail to provide required CAN-SPAM business address
Email Deliverability Issues: If emails bounce due to your domain reputation (not ZeroCart's fault)
Spam Folder Placement: If recovery emails land in spam due to your sending practices (unrelated to ZeroCart)
AUP Violations: If account was paused or restricted for Acceptable Use Policy violations during measurement period
Service Interruptions: If you paused email sending or disabled tracking snippet during measurement period
Niche/Unusual Products: Products with inherently low recovery potential (e.g., one-time emergency purchases, highly regulated goods)

2.4 How to Claim Performance Guarantee

3. General Conditions (Both Guarantees)

3.1 Non-Transferable

Both guarantees are non-transferable. They apply only to the original account holder and cannot be transferred to another person or business entity.

3.2 One Guarantee Per Account

You can claim either the 14-Day Money-Back Guarantee OR the Performance Guarantee, but not both. Claiming the 14-day refund forfeits eligibility for the Performance Guarantee.

3.3 Good Faith Requirement
